Do I need an attorney when I get arrested for DUI

Most people who get arrested for driving under the influence (DUI) have no prior experience in the justice system and have no criminal record. As a criminal defense lawyer in Los Angeles and throughout Southern California, I have spoken with many friends and family about what they should do if they get charged with a DUI.

Many believe that a lawyer is an added expense which just creates additional costs for a person who is charged with driving under the influence. However, being charged with a crime can be quite serious and traumatic even though it is a DUI as opposed to a murder case. There are many things a lawyer can do for you when you are charged with a DUI. Those most immediate benefit is that an attorney in a misdemeamor DUI case can appear on your behalf and you will not have to attend court personally in many instances. Obviously, if your attorney believes that it is beneficial to take your case to trial it is always wiser to be there for the trial.

In addition, in California, when you are charged with a DUI, you need representation both in court and in a separate adminstrative proceeding with the DMV. When you are arrested for DUI, the DMV initiates a proceeding to suspend or revoke your driving privileges depending on the type of DUI charged including whether or not there was refusal to take a chemical test or whether you have a prior DUI conviction.

A competent criminal defense attorney can defend you in both Court and in aDMV proceeding and after a review of the charges, police report, maintenance records of the breathalyzer machine, and conferring with their expert toxicologist, can you give a person the best chance to receive the best possible outcome in dealing with such a stressful situation which could mean a reduction of the charges, reduction of the sentence or an outright dismissal of the charges.
